Question by Ashley Marksbury: how can i get my same sex fiance to the usa ?

hello my name is Ashley i was born in the usa and my partner lives in the uk, we are engaged and the same sex , what is the best visa for her to come and live here in the usa ... i have asked around and got different answers every time i was told that for the k1 fiancé visa we couldn't apply because they don't have a fiancé visa for same sex marriages and was told also its depending on the officer that deals with the application i don't know what to do ???

The only advice I can give you is to have her come over on a visitor's visa, marry in one of the states like Ma where it is allowed then sue... in about 10 years it might get to the Supreme Court.

I have been in your exact shoes btw. My ex-significant other of 6 years came over on a visitor's visa when we met.. we kept extending her visitor's visas until finally there were no more allowed without a break. Btw, you are not allowed to work or attend school on a visitor's visa so she was a bit bored. I ended up going to her country on a visitor's visa for a year... we went back and forth this way... I truly think that is what came between us.

Note: Until DOMA, Defense of Marriage Act, is reversed the federal government isn't going to acknowledge your marriage. I completely feel for what you are going through... I've been there and it is very difficult.
